UK businesses face new reputation risk: publicity orders

Get free weekly news by e-mailFrom Monday 15th February UK businesses face a new reputation risk related to the Corporate Manslaughter and Corporate Homicide Act 2007.

On that date Section 10 of the Act comes into effect. It allows judges to make a ‘publicity order’ requiring a convicted organization to actively highlight:

(a) The fact that it has been convicted of the offence;
(b) Specified particulars of the offence;
(c) The amount of any fine imposed; and
(d) The terms of any remedial order made.

The order must specify the period in which its requirements are to be met and may require the convicted organisation to supply the relevant enforcement authority with evidence that those requirements have been complied with.

Details have been published by the Ministry of Justice in Circular 2010/04.
